A third wastewater system is going to the Missouri Attorney General.

In a release,  the Missouri Department of Natural Resources says the Niangua Vista Condominium Owner's Association will go before the Chris Kosterl.

The Niangua Vista condos are located on state Highway EE near the Little Niangua Arm.

The MoDNR says the state operating permit for the facility expired January 23rd of 2008.  Niangua Vista filed a renewal application in October of 2008.  On January 28th of this year the MoDNR determined that the application for renewal was incomplete due to a lapse of corporation status.  The Missouri Secretary of State reinstated the corporation but the association did not resubmit their renewal application until October of this year.

MoDNR also says Niangua Vista failed to file discharge monitoring reports 13 times between 2006 and 2008.  Niangua Vista was issued a warning April 24th, and two violation notices, one on August 13th and one last month on the 14th.  MoDNR says all of those factors led to the referral to the attorney general.

Niangua Vista is the third treatment facility referred to the A.G.'s office with Van's Mill Creek in Gravois Mills and Bluff Point Estates in Lake Ozark being referred last week.
