| Ruling Could Clear the Way for TIF Trial |

Four Seasons Marina Rentals and Four Seasons Lakesites had asked a local judge for a jury trial and change of venue in the case. That challenge went all the way to the Missouri Supreme Court which denied it yesterday. Four Seasons filed suit after Osage Beach approved $3 million dollars in Tax Increment Financing for the project. The suit said the determination of blight in the case was an abuse of the incentive. Osage Beach Mayor Penny Lyons discussed the news from the supreme court at last night's budget meeting. "We've been ready for two years," Lyons said. "We're not the ones that have said that we are not ready. Every time we have been asked we've said we're ready." "And it's not the city as much as it is Mr. Hammons. We're partners in it but they have the major attorneys and everything in there." "We're ready to go." The case has now been all the way to the federal level and through the Missouri Court of Appeals and the Camden County Circuit. The case will now offically be tried before a Camden County judge on December 14th. |
